Waiver: In consideration of being permitted to participate in any lessons, gatherings, activities, or events, sponsored by, affiliated with, occurring on property owned by Looking Glass Studio, L.L.C., hereinafter referred to as “L.G.S., L.L.C.” but unassociated with L.G.S., L.L.C. or in any way associated with L.G.S., L.L.C., but occurring at or in a different venue, hereinafter referred to as “The Activity”, I, the undersigned, for myself, my heirs, personal representatives or assignees, do hereby waive, discharge, and release L.G.S., L.L.C., its officers, employees, teachers, volunteers, agents, hired independent contractors, affiliated clubs, other students/participants, sponsoring agencies, sponsors, advertisers, owners and/or lessors of premises used to conduct “The Activity”, from and against any and all liability arising out of participating in The Activity, including but not limited to all claims for (i) personal injury(including death); (ii) loss of, or damage to, any personal or co-owned property, personal or otherwise; and (iii) expense, time loss or inconveniences caused by persons listed above, changes in schedule, failure to act or negligence of any persons listed or not listed above but associated with L.G.S., L.L.C., illness, including but not limited to Covid-19 or any SARS virus strains, weather, strikes, governmental actions or acts of god.

Assumption of Risks: Participation in The Activity carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The specific risks vary from one activity to another, but the risks to bodily harm range from: 1) minor injuries such as scratches, bruises, and sprains; 2) major injuries such as any type of fall, broken limbs, head or brain injuries, joint or back injuries, heart attacks; to 3) catastrophic injuries including paralysis and death; The undersigned assumes all risk and responsibility for actions taken, intended or unintended, before during or after The Activity. Indemnification and Hold Harmless: I agree to Indemnify and Hold Harmless L.G.S., L.L.C. from any and all claims, actions, suits, procedures, costs and expenses including but not limited to damages, liabilities, medical or legal expenses including but not limited to attorney fees and costs brought as a result of my involvement in The Activity. Severability: The undersigned further expressly agrees that the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by the law of the State of Michigan and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

Participation/Equipment Authorization: Participant agrees to follow the L.G.S., L.L.C. Code of Conduct. Participant understands that all equipment and apparatus in and around L.G.S., L.L.C. is highly specialized, and solely owned by L.G.S., L.L.C., and as such, participant will not touch, move, use, or otherwise activate any equipment including but not limited to Cyr Wheels, Lyra or aerial fabric, musical equipment, any items in kitchen area, or any other area without express permission to utilize such equipment. Participant agrees to use any equipment with caution, and expressly agrees to only use any equipment when given authorization, and in the fashion instructor or persons listed above has prescribed. Any unauthorized use will be cause for immediate expulsion and a forfeit of all fees paid. Any equipment found broken or damaged will be replaced by Participant of The Activity. Replacement fee will be calculated buy L.G.S., L.L.C. and deducted from any deposit and the remainder billed to the client. Any and all legal recourse will be pursued should Participant refuse replacement fee.

Acknowledgment of Understanding: I have read this waiver of liability, assumption of risk, indemnity agreement, and Participation/Equipment Authorization and fully understand its terms and condition. Participant understands that I am giving up substantial rights, including my right to pursue legal action in any way or sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.

I have read the previous paragraphs and I know, understand, and appreciate these and other risks that are inherent in The Activity. I hereby assert that my participation is voluntary and that I knowingly assume all such risks.
